MADISON — Dale Lowther, Jr. pled guilty to malicious assault in Boone County Circuit Court on last week.
Lowther, 34, of Van, was sentenced to 2 to 10 years in prison, according to Boone County Prosecuting Attorney Keith Randolph.
According to a criminal complaint filed at the courthouse, Lowther did fire multiple rounds at Gary Hubbard with a .22 caliber rifle back in 2013 while Hubbard was operating his vehicle on WV Route 5. Hubbard was struck with three rounds while seated in the driver’s seat of the vehicle, the report said.
Police said evidence showed that the firearm was discharged by Lowther in the roadway.
Lowther was originally charged with attempted murder. He took a malicious assault plea and will serve at least two years behind bars and not more than 10 years.
The Boone County Sheriff’s Department handled the investigation into the shooting.
