A 30-year-old Big Coal River area resident that received a second chance after committing a drug-related crime is headed to prison after breaking probation. Court documents show that on Nov. 4, 2005, sheriff’s deputies arrested Rhiannon Danielle Kirk, of Hernshaw, on drug charges after a visit to her home.
A complaint filed in Boone County Magistrate Court said Deputy J.L. Barker traveled to a Hernshaw residence with Child Protective Service workers. While there, Barker discovered the precursor chemicals used in the production of methamphetamines. Investigators also discovered the burned remnants of meth making chemicals behind the home.
In a statement to investigators, Kirk admitted to purchasing products for her husband to “cook meth” with. The meth lab was located in Kirk Hollow Road. The woman was charged with attempting to operate a clandestine drug lab. She was indicted on those charges later that year and entered a guilty plea to them.
Boone County Circuit Judge E. Lee Schlaegel accepted her plea and sentenced her to a term of two to 10 years in state prison. He then suspended the sentence and placed Kirk on five years probation.
By all accounts, the woman abided by the terms of her incarceration until April 2008, when she quit reporting to the probation department on a monthly basis as she agreed to in court. Last June, probation officers filed documents asking Judge Will Thompson to revoke her probation. On Jan. 28, 2009, the judge did just that, ordering Kirk back to prison to serve the remainder of her sentence.
