A negligence lawsuit filed against Independence Coal Company Inc., has the Boone County Courthouse tied up hearing testimony this week.
Boone County Judge Will Thompson has been presiding over the case of Stevenson versus Independence Coal Company, Inc.
A jury was selected to hear testimony in the case, which alleges negligence resulting in the injury of an employee while on the job.
Stanley Stevenson, II, alleges he received bodily injuries in January 2005 caused by the negligence of Independence Coal Company, Inc.
Stevenson was a general laborer and belt man, operating a mantrip at the Justice Mine during the end of January 2005.
His job placed him in close proximity to tracks and electric wiring, but it was an alleged dangerous and defective braking system that Stevenson blames for his injuries.
He claimed in a deposition to the court that his right hand was caught in the braking system between the brake head and the frame of the mantrip.
In his deposition, Stevenson claims that the company’s two-way radios rarely worked and the faulty braking system was reported every day.
The jury will continue hearing testimony this week, with the defense expected to present their case sometime next week with closing arguments anticipated for the week of March 16.
