Woman arrested in forgery case receives a second chance

A 25-year old mother of two has received a second chance from Boone County Circuit Judge Will Thompson in a forgery case. On December 15 of last year, Trooper L.J. McClung, of the West Virginia State Police was called by the daughter of an elderly woman who was concerned about strange checks written on her mother’s account.

The trooper determined that Samantha Cain had debited money out of the account of Escelene Moore on two occasions. When McClung interviewed Cain, she admitted to using some of the money for drugs, and the rest to pay an overdue $99 electric service bill at her home. “She told this officer she had two children at home and feared having her electric shut off,” McClung said in her complaint.

In a plea agreement entered into last week, Cain agreed to plead guilty to obtaining money under false pretenses, which is a misdemeanor. Judge Thompson agreed to accept her plea and suspended the sentence. In addition, Cain was placed under the supervision of the Boone County Drug Court.

Her agreement states that if she successfully completes drug court and a six month period of probation, her sentence will be dismissed.

In addition, she agreed to plead guilty to forgery and uttering, which is a felony charge. Thompson also agreed to accept her plea but suspend the sentence and place her in drug court. If the woman successfully completes drug court and six months of probation, the case will be dropped.

Thompson explained to Cain that if she violates the terms of her acceptance to drug court, the judge has the right to send her to prison to finish her sentence.
