Man recently released from prison pleads guilty to DUIU

A Boone County resident recently released from prison in Alabama is likely headed back for another extended stay in custody after a recent felony plea. His criminal history includes a sexual assault conviction in another state and at least 10 DUI arrests. Kenneth Allen Puckett, 48, entered into a plea agreement, which could send him to prison for up to a possible combined eight years. The case began in 2002, when Puckett was pulled over on a routine traffic stop by Trooper M.T. Smith, of the West Virginia State Police. When the trooper ran a routine check of Puckett’s driving history, the officer discovered the man had been convicted of DUI on two previous occasions. The complaint stated "the defendant appears to have had ten prior DUI arrests in West Virginia and Alabama between 1995 and the present date (2002)." His criminal history appeared to show eight prior DUI related misdemeanor convictions as well. West Virginia DMV records indicate Puckett was convicted of DUI on July 21, 1996, Jan. 2, 2002 and May 29, 2009. The trooper charged Puckett with a felony 3rd offense DUI and the man was subsequently released on bond. While awaiting trial, the court was unable to locate Puckett, and he was charged with jumping bond. Records indicate Puckett was arrested in Alabama on charges of first-degree sodomy in 2006 while he was wanted in West Virginia. Puckett served a prison term in connection with the Alabama charges and when he was released, state officials informed the West Virginia State Police that he was a convicted sex offender and planned to return to Boone County. Records indicate that troopers from the Madison Detachment attempted to locate Puckett on several occasions last May to register him in the sex offender database. Cpl. L.J. McClung said she and other troopers attempted to inform him of his obligations under state law several times and was unable to locate him. McClung and another trooper finally discovered Puckett was living in an apartment in Marthatown, which was not the residence he listed with Alabama officials at the time of his release. Puckett was charged with the felony offense of failing to register as a sex offender, as well as the initial felony DUI arrest from 2002. In court last week, Puckett admitted to the offenses. Court records said the man claimed to suffer from bi-polar disorder as well as being afflicted with liver and heart ailments. When the defendant returns to Judge Thompson’s court he faces a possible sentence of one to three years imprisonment for the felony DUI conviction and not less than one year and no more than five years in prison for failing to register as a sex offender. In the DUI case he also faces a possible fine of $3,000-$5,000.
